The Government has been making numerous changes to employment legislation over the last year or so however, what we learn about in the news is rarely the full picture and employers are at risk of being lulled into a false sense of security.
For example, some employers may believe that the introduction of pre-termination negotiations (confidential discussions with employees about issues, with a view to terminating employment on agreed terms) allows them to address concerns as they see fit, without any fear of the conversation being used against them in a tribunal. This is not the case. If the conversation is deemed to be discriminatory or ‘improper’, or if any subsequent dismissal is categorised as ‘automatically unfair’, then the conversation loses its protection and can be used in evidence.
Likewise, many employers still misunderstand the implications of the claim period for ordinary unfair dismissal (which increased from 1 to 2 years in 2012) and are putting themselves at risk of lengthy employment disputes.
